Appeal court quashes Barco IP claim against Norxe projector technology

Projector manufacturer Norxe is celebrating a court ruling in its favour after legal wrangling with Barco over whether Norxe’s P1 projector was built on Barco technology.

Norxe put out a statement to announce the ruling: “In a recent verdict from Borgarting Appeal Court dated February 11th, 2021 (not yet legally enforceable), the Appeal Court reaffirms that Norxe P1 is 100% Norxe technology in collaboration with strategic partners.”

Barco NV and Barco Fredrikstad AS brought the original lawsuit against Norxe AS and 10 of its employees. Fredrikstad District Court acquitted Norxe and its employees in 2019 after a two-year legal battle.

A press release from Norxe hints that the litigation might not be over yet saying: “The Appeal Court found that Barco is liable for any economic loss their behaviour has inflicted upon Norxe. Though Barco's legal liability has been established, the level of financial loss will be subject to negotiations or new legal proceedings.”

Espen Olsen, vice president global sales at Norxe, said: “We will now focus 100% on developing, manufacturing and selling our unique projectors to select and demanding partners world-wide. We owe our partners a great appreciation for standing alongside and supporting us through these difficult times and the increased strength in relationships that this support has forged.”

In a statement Barco said: “It has been a tough case for both parties, but the starting point has been that it was believed that there was such clear evidence of objectionable actions that the outcome was a trial.

“Barco is of course disappointed not to have been heard in the case. We will now take the time to process this comprehensive ruling (106 pages in Norwegian) and it will be thoroughly reviewed internally.”
